Terms of Service
Last updated: October 14, 2026 · Version 2026-10-14 · The Spanish version at /legal/terminos is the one clients accept; this translation is provided for convenience.
1. Who we are and what the service is
Centro de Mando (“the console”, “the service”) is a product of Offerae LLC, a Florida (USA) limited liability company (“we”). It is an AI marketing console for small businesses: from what you ask for, it produces videos with an animated presenter, social-media posts and campaigns, and prospect lists; it posts to your social accounts when you approve; it reads those accounts' metrics and comments; and it serves you through the web console and a Telegram assistant.
By creating an account, paying for the plan or using the console you accept these terms, the Privacy Policy and the Refund Policy. You must be at least 18 and use the service for a business.
2. Your account
- One account is one business. You are responsible for the password and for what is done from your account, and for telling us if you believe someone else got in.
- We (the operator) may enter your console to give support, fix a job or bill what is due, and only for that.
- Your console's data lives on our servers while the account is active; what we keep and for how long is in the Privacy Policy.
3. Plan, usage, packs and presenter
- Monthly plan. A recurring monthly fee (Básico, Pro or Negocio, per the pricing page) gives access to the console and to what each plan includes, with an amount of usage credits each month (1 credit = US$1 of usage). Included credits expire at the end of each billing month and do not roll over; the first month's welcome credits expire with that month.
- Usage. Every job (a video, a post, a campaign, a prospecting run, a round of corrections) shows its price before you approve it. On approval that price is taken first from the month's included amount, then from your prepaid balance. Usage once consumed is non-refundable: once a job starts, the providers' cost has been incurred.
- Credit packs are prepaid balance. They never expire: they are spent while a plan is active and, if the plan ends, they are kept for when you reactivate it (what the Refund Policy says about refunds is unchanged by this).
- Presenter. Creating a presenter (your animated character and, if you choose, your voice) is a one-time fee paid for every new presenter. It covers the creation; every video made with it is billed as usage.
- Prices are on the pricing page. Usage prices are estimates based on the providers we use and may change; the exact price of each job always appears before approval. A change to the plan fee is announced by email 30 days ahead.
- Negative balance. A job may cost slightly more than its estimate. If your balance goes below zero you cannot start new jobs until you top up; what was already running is finished.
4. Payments, Paddle and cancellation
Payments are processed by Paddle (Paddle.com Inc. for U.S. transactions; Paddle.com Market Limited for the rest of the world), our merchant of record. Paddle charges, invoices, applies the taxes due and handles refunds under the Refund Policy. We never see or store your card details.
- The plan renews monthly until you cancel. You can cancel at any time from “Costo” in the console, by writing to support@offerae.com, or through Paddle at paddle.net.
- Cancellation takes effect at the end of the paid period; until then the console keeps working. No refunds on partial periods.
- If a charge fails we tell you and you have 7 days to update the payment; after that the console goes read-only (reports and pages visible, no new jobs) until the charge completes.
- When the plan ends, the console goes read-only. Your data is kept 30 more days and then deleted per the Privacy Policy, except billing records.
5. Acceptable use
You may not use the service for unlawful activity, spam, fraud, harassment, hate speech, sexually explicit content, or to deceive anyone. In particular:
- Third parties' voices and likenesses. You may only clone your own voice and create a character from your own photo (or from a person who expressly authorized it in writing, with an authorization you can show us). Uploading another person's voice or image — a celebrity, a competitor, a relative, a customer — without that authorization is prohibited. Before cloning a voice or creating a character from a photo, the console asks for a signed consent that we store with date, time and IP address.
- Impersonation. Nothing the console produces may be presented as said or done by a real person who did not say or do it.
- Regulated advertising. If your line of business has advertising rules (real estate, lending, health, food, alcohol, financial or legal services, etc.), you are responsible for every piece complying with them, including mandatory notices, broker or licensee information and disclaimers (for example fair-housing and financing disclaimers in real estate). The console can help include them if you put them in your rules, but it does not replace your review or your advisor's.
- Your social accounts are yours. You connect them and you authorize each post. Complying with each platform's rules is your responsibility; a platform suspending your account is not a failure of the service.
- You may not resell the service, deliberately overload it, try to reach other businesses' data or our systems, or use the assistant to extract people's data without a legal basis.
We may suspend or close an account that breaches these terms, without notice when the breach is serious or affects third parties.
6. Your content and ours
- Yours is yours. What you upload (material, photos, recordings, texts, rules, business data) and what the console produces for you (videos, posts, campaigns, lists) belongs to you. You grant us only the license needed to store it, process it with the providers listed in the Privacy Policy, show it to you and publish it where you direct.
- You warrant that you have the rights to everything you upload and that it does not infringe others' rights (copyright, trademark, likeness, privacy). You answer for claims arising from material you had no right to use.
- Anonymized metrics. We may use aggregated, anonymized usage data (how many videos are produced, which formats work, what a job costs) to improve the service. We never publish your identifiable content or results without your permission.
- Ours. The console, its code, templates, library voice and sample characters are ours or our licensors'. You may not copy them or use them outside the service.
7. Artificial intelligence: what you should know
- The texts, images, voices and videos the console produces are generated by AI models from the providers listed in the Privacy Policy. They may contain factual errors, wrong figures, invented names or imperfect images. Review every piece before approving it; the console shows it with its price for that reason.
- Presenter videos carry a label saying they are AI-generated content, and the console keeps it. Some platforms and some laws require it; do not remove it.
- You decide what gets published. What you approve and publish is yours, with its legal and commercial consequences. We accept no responsibility for content you approve.
- We guarantee no results: no sales, customers, followers, reach or search rankings. Example figures on our pages are illustrative.
8. Availability and changes
We do what is reasonable to keep the console available and to take daily backups, but the service is provided “as is” and “as available”. It depends on third-party providers (AI models, voice, video, posting, payments) that may fail or change their prices or terms; when that affects a job we tell you and nothing that was not produced is charged. We may change or withdraw features with reasonable notice.
9. Limitation of liability
To the extent the law allows, Offerae LLC's total liability to you for any claim related to the service is limited to what you paid for the service in the 3 months before the event giving rise to it. We are not liable for lost profits, lost revenue, lost data, reputational harm or any indirect, incidental or consequential damages, or for decisions you make based on what the console produces. Nothing here limits liability the law does not allow to be limited.
You will hold us harmless from third-party claims arising from your content, your posts, a voice or likeness you uploaded without the right to, or your breach of these terms.
10. Termination
You may close your account at any time (section 4 and “Mi negocio” in the console). We may close it for breach of these terms, with notice except in serious cases. On closure the retention and deletion periods of the Privacy Policy apply.
11. Governing law and disputes
These terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in Florida, and you accept their jurisdiction. If you are a consumer in a jurisdiction whose laws grant you rights that cannot be waived, those rights are unaffected.
12. Changes to these terms
We may update these terms. For a material change we notify you by email 30 days ahead; continuing to use the service after that date means you accept it. The current version is always on this page.
